These terms govern the use of this website and the legal services provided by rattanay Legal. Please read them carefully. By using this website or engaging our services, you agree to these terms.

1. Definitions

2. Acceptance of Terms

By using this website or by signing an engagement letter with the firm, you confirm that you have read and agree to these terms. You confirm that you are at least 18 years of age and that you have the capacity to enter into a legally binding agreement under Thai law.

If you are acting on behalf of another person or entity, you confirm that you have authority to bind that person or entity to these terms.

3. Services

rattanay Legal provides legal services in Thailand in the area of inheritance and succession law. The specific scope of any engagement is set out in the engagement letter issued before work begins. The services described on this website are available to clients based in Thailand and to foreign nationals with assets or succession matters subject to Thai law.

Use of this website does not itself constitute the formation of a client-firm relationship. A client relationship is formed only upon the firm's written confirmation of an engagement.

4. Your Responsibilities

When using this website or engaging our services, you agree to:

5. Intellectual Property

All content on this website — including text, design elements, and structure — is the property of rattanay Legal or its licensors and is protected by applicable Thai intellectual property law. You may read and print content for personal, non-commercial use. You may not reproduce, republish, or distribute any content without prior written permission.

Legal documents, letters, and materials prepared by the firm in the course of an engagement remain the firm's intellectual property until all fees have been settled, at which point they are provided to the client for their use in connection with the matter.

6. Fees and Payment

The fee for each service is set out in the engagement letter and agreed in writing before work begins. Current indicative service fees are stated on this website in Thai Baht (THB). Disbursements — including court filing fees and expert witness fees — are quoted separately and disclosed before being incurred.

Payment is due within 14 days of the firm's invoice unless otherwise agreed in writing. The firm reserves the right to pause work on a matter if fees remain unpaid beyond this period, following written notice.

Fees paid for services already commenced are not refundable unless the firm is unable to complete the agreed scope due to its own fault. Any overpayment will be refunded promptly on close of the matter.

7. Confidentiality

The firm treats all client information as strictly confidential and subject to professional obligations of privilege and confidentiality under Thai law and Bar rules. Client information will not be shared with any third party without the client's written authority, except where required by law, court order, or regulatory obligation.

8. Disclaimers

The content on this website is provided for general information only and does not constitute legal advice. No reliance should be placed on website content without first obtaining specific advice from a qualified practitioner in relation to your particular circumstances.

Legal outcomes in succession matters depend on the specific facts, applicable law, and the decisions of courts or other parties. The firm makes no representation that any particular result will be achieved in any matter.

9. Limitation of Liability

To the extent permitted by Thai law, the firm's liability in connection with any engagement is limited to the fee paid for the specific service in respect of which a claim arises. The firm is not liable for indirect, consequential, or special damages arising from any engagement or from use of this website.

Nothing in these terms limits the firm's liability for fraud, wilful misconduct, or any matter that cannot be excluded under Thai law.

10. Termination of Engagement

Either party may terminate an engagement by written notice. If you terminate an engagement after work has commenced, a fee proportionate to the work completed to the date of termination is payable. The firm may terminate an engagement if you fail to provide instructions within a reasonable time, if there is a breakdown in the working relationship, or if required by professional rules.

On termination, the firm will provide the client with a written summary of work completed and the status of the matter at the date of termination.

11. Governing Law and Dispute Resolution

These terms are governed by the laws of Thailand. Any dispute arising from these terms or from a client engagement will first be referred to informal resolution through direct correspondence. If not resolved within 30 days, either party may refer the matter to the jurisdiction of the Thai courts in Bangkok.

Complaints about the firm's professional conduct may also be referred to the Lawyers Council of Thailand.

12. General Provisions

13. Changes to These Terms

We may update these terms from time to time. The date at the top of this page reflects the most recent revision. Continued use of this website after a revision constitutes acceptance. Changes will not affect the terms of an existing engagement unless both parties agree in writing.
